A BILL TO BE ENTITLED
AN ACT
To amend Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated, relating to general provisions regarding insurance generally,
so as to require health benefit policy coverage for vaccinations for cervical cancer and the human papillomavirus; to provide for related matters; to
repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Article 1 of Chapter 24 of Title 33 of the Official Code of Georgia Annotated, relating to general provisions regarding insurance generally, is amended by
inserting a new Code section to read as follows:
o 33-24-56.5.
(a) As used in this Code section, the term:
- (1) 'Health benefit policy' means any individual or group plan, policy, or contract for health care services issued, delivered, issued for delivery,
executed, or renewed in this state on and after July 1, 2007 by an insurer, including, but not limited to, any health insurance plan or other health care
services provided pursuant to Article 1 of Chapter 18 of Title 45, Article 7 of Chapter 4 of Title 49, or Article 13 of Chapter 5 of Title 49.
- (2) 'Insurer' means any person, corporation, or other entity authorized to provide health benefit policies under this title.
(b) Every health benefit policy shall provide coverage for federal Food and Drug Administration approved vaccinations to prevent cervical cancer
and the human papillomavirus in such frequencies and at such ages as recommended by the federal Canters for Disease Control and Prevention and
deemed appropriate by the attending physician after conferring with the patient or his or her parent, if the patient is a minor.
(c) The benefits provided in this Code section shall be subject to the same annual deductible; or coinsurance established for all other covered
benefits within a given health benefit policy.
SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
